Clevr House Digital Goods & Physical Products License Agreement

Welcome to Clevr House. This License Agreement explains the terms under which you purchase and use our digital goods (PCB layouts, schematics, Gerber files, firmware, software, STL files, and related design files) and our physical products (assembled PCBs, kits, and hardware). Please read it carefully before purchase or use.

1. Company Information

Clevr House is operated by Clevr House SRL, registered in Romania.

2. Acceptance of Agreement

By placing an order on our website, clicking “I agree” at checkout, downloading any digital file, or using any physical product purchased from us, you accept and agree to be bound by this Agreement. If you do not agree, do not complete your purchase and do not use our products or files.

3. Scope of License — Digital Goods

When you purchase a digital product from Clevr House, you receive a personal, non-exclusive, non-transferable, non-sublicensable, revocable license limited strictly to the uses described in Section 4. You do not acquire ownership of the files, designs, or any intellectual property. All rights not expressly granted are reserved by Clevr House.

This is a proprietary license. No open-source, Creative Commons, or similar public license applies to our digital products unless explicitly stated in the product listing or in a separate written agreement signed by Clevr House.

4. Permitted Uses — Digital Goods

You may:

  • Build for personal use: Download the files and manufacture or assemble physical devices for your own personal, non-commercial use, in quantities reasonably consistent with personal household use.
  • Share your work: Publish photos, videos, or written descriptions of devices you have built from our designs, provided you credit Clevr House and include a link to https://clevrhouse.com.
  • Privately modify: Adapt the files strictly for your own personal use on your own devices. You may not distribute, publish, share, upload, or otherwise make available any modified version in any form.

5. Restrictions — Digital Goods

You may NOT:

  • Use the files, or any physical devices manufactured from them, for any commercial purpose as defined in Section 6.
  • Redistribute, resell, sublicense, lend, rent, upload, mirror, share, or otherwise make available the original or modified digital files to any third party, whether free or for a fee, whether publicly or privately. This prohibition expressly includes but is not limited to: Gerber files, drill files, pick-and-place files, schematics, bill of materials, firmware source code and compiled binaries, 3D models (STL, STEP, F3D, STP), CAD files, documentation, images, and any other file we provide as part of a digital product.
  • Upload the files to public or private repositories, cloud storage shared with others, file-sharing services, forums, Discord servers, Telegram channels, or any other distribution channel.
  • Reverse-engineer, decompile, or disassemble our firmware or software, except to the minimum extent permitted by mandatory applicable law.
  • Remove, obscure, or alter any copyright notices, trademarks, watermarks, or attribution embedded in files, silkscreen, firmware, or packaging.
  • Manufacture copies of our PCBs or hardware for resale, distribution, or any use beyond your personal use.
  • Use our files, designs, images, or documentation to train, fine-tune, or develop machine learning or artificial intelligence models.

Each user must obtain their own license by purchasing directly from Clevr House. Sharing files with a friend, family member, or colleague — even free of charge — is not permitted.

6. Definition of “Commercial Use”

For the purposes of this Agreement, “commercial use” includes, without limitation:

  • Selling, reselling, or leasing devices built from our designs
  • Providing paid installation, configuration, or consulting services that rely on our designs
  • Using devices in short-term rental properties (e.g., Airbnb, hotels, guesthouses) operated as a business
  • Using devices in any premises open to the public as part of a for-profit enterprise
  • Producing monetized content (YouTube videos with ad revenue, sponsored posts, paid courses, paid tutorials) where our designs are the primary subject
  • Using devices as part of the operations of a for-profit business, beyond incidental personal use by an employee at their own home

If you are unsure whether your intended use is commercial, contact license@clevr.house before proceeding. Commercial use is available under a separate written license — see Section 14.

7. Intellectual Property

All intellectual property rights in the digital files, physical product designs, documentation, firmware, artwork, logos, and trademarks remain the exclusive property of Clevr House. No rights are transferred by purchase beyond the limited license described in this Agreement.

8. Third-Party Open-Source Components

Our firmware or software may incorporate third-party open-source components (for example, ESPHome, Arduino core, FreeRTOS, or other libraries). Such components remain subject to their own respective licenses, which are listed in accompanying NOTICES, LICENSES, or README files included with the firmware. Nothing in this Agreement overrides, restricts, or modifies those third-party licenses. Clevr House’s proprietary license applies only to the original material authored by Clevr House.

9. Physical Products — Ownership and Warranty

9.1 Ownership

When you purchase a physical product (assembled PCB, kit, or hardware), you own the physical item. Intellectual property rights in the underlying design remain with Clevr House.

9.2 Legal Guarantee (EU Consumers)

If you are a consumer residing in the European Union, your purchase is covered by the mandatory 2-year legal guarantee under Directive (EU) 2019/771, as transposed into Romanian law. This guarantee covers defects in materials or workmanship present at the time of delivery.

9.3 Warranty Claim Procedure

To make a warranty claim:

  1. Contact us at warranty@clevr.house within the guarantee period, describing the defect and including your order number.
  2. Provide proof of malfunction. Acceptable evidence includes:
    • Clear photographs of the product from multiple angles
    • A short video demonstrating the fault
    • Test measurements where relevant (e.g., multimeter readings, serial/debug logs, screenshots)
    • Proof of purchase (order number or receipt)
  3. We review and respond, typically within 7 business days.
  4. If the claim is accepted, we will ship a replacement unit free of charge. You are not required to return the defective unit. We may ask you to photograph the defective PCB with a visible mark drawn across it (e.g., a permanent marker line) to confirm it has been retired from use, to prevent duplicate claims or resale.

We reserve the right to request additional information reasonably necessary to assess a claim. Claims that cannot be substantiated after good-faith review may be declined.

9.4 Exclusions

The legal guarantee does not cover:

  • Damage caused by improper assembly, soldering, installation, wiring, or handling
  • Use of incompatible, counterfeit, or faulty third-party components
  • Modifications, alterations, or misuse of the PCB or hardware
  • Damage caused by incorrect voltage, reversed polarity, short circuits, electrostatic discharge, moisture, or environmental conditions outside the published specifications
  • Normal wear and tear
  • Cosmetic imperfections that do not affect functionality

9.5 Business Purchases (B2B)

If you purchase as a business rather than as a consumer under EU consumer law, physical products are sold “as-is” without warranties beyond those mandatorily required by law. The business purchaser is responsible for inspection and for determining fitness for its intended purpose.

10. Digital Products — No Warranty

All digital products are provided “as-is” and “as-available” without warranties of any kind, express or implied, to the maximum extent permitted by law. Clevr House does not guarantee that files are error-free, bug-free, compatible with any specific tool or hardware combination, or compliant with any particular safety or regulatory standard when manufactured by the user. Nothing in this section limits any non-waivable statutory rights you may have as a consumer.

11. Right of Withdrawal (EU Consumers)

11.1 Physical Products

You have the right to withdraw from the purchase of physical goods within 14 days without giving any reason. The withdrawal period expires 14 days after you take physical possession of the goods.

To exercise your right of withdrawal, send a clear statement of your decision to office@clevr.house or by post to our registered address. You may use the model withdrawal form set out in Annex I of Directive 2011/83/EU, available on request.

11.2 Digital Products

The 14-day right of withdrawal does not apply to digital content if performance has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal. By placing an order for digital goods and accessing or downloading any file, you give this express consent and acknowledge the loss of the withdrawal right.

12. Producer Obligations and Your Responsibilities

Clevr House complies with applicable EU producer obligations for our physical products, including CE marking (where applicable), RoHS (Directive 2011/65/EU), WEEE (Directive 2012/19/EU), and REACH (Regulation (EC) 1907/2006). Compliance information is available on our Compliance page.

You are responsible for:

  • Compliance with local electrical, building, fire-safety, and installation codes
  • Using appropriate protective equipment and qualified personnel (e.g., a licensed electrician) for any mains-voltage work
  • Any device you manufacture yourself from our digital files — self-manufactured devices are not covered by CE marking or other certifications, which apply only to products we physically ship
  • Proper disposal of electronic waste in accordance with local law

13. Limitation of Liability

To the maximum extent permitted by applicable law, Clevr House, its owners, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including without limitation property damage, loss of data, loss of profits, business interruption, or financial loss, arising from the use of our products, files, or services.

Nothing in this Agreement excludes or limits liability for:

  • Death or personal injury caused by our negligence
  • Gross negligence or willful misconduct
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under applicable Romanian or EU consumer law
  • Defects giving rise to liability under the Product Liability Directive (85/374/EEC, as revised)

For consumers, our total aggregate liability for any claim directly related to a product is limited to the price you paid for that product, except where prohibited by law.

14. Commercial Licenses

If you wish to use our designs, files, or hardware for any commercial purpose, you must first obtain a separate written license from Clevr House. Contact license@clevr.house with details of your intended use, scale, and market. Unlicensed commercial use is a material breach of this Agreement and may result in immediate license termination, demand for retroactive license fees, and legal action.

15. Age Requirement

Our products include electronics and, in some cases, components intended for use with mains voltage. You must be at least 16 years old to purchase from us. Customers under 18 should have parental supervision when assembling kits or installing devices involving mains voltage.

16. Termination

This license terminates automatically if you breach any material term of this Agreement. On termination, you must cease all use of the digital files and destroy any copies in your possession and control. Sections concerning intellectual property, restrictions, limitation of liability, governing law, and dispute resolution survive termination.

17. Changes to this Agreement

We may update this Agreement from time to time. Purchases are governed by the version of the Agreement in effect at the time of your order. Updates do not apply retroactively to digital goods already purchased, except where required by law. The “Last Updated” date and version number at the top of this Agreement reflect the current version.

18. Force Majeure

Clevr House is not liable for delays or failure to perform caused by events beyond our reasonable control, including war, acts of government, customs delays, postal or carrier failures, pandemics, natural disasters, component shortages, or disruption of essential utilities or services.

19. Severability

If any provision of this Agreement is found by a competent court to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20. Assignment

You may not assign or transfer this Agreement or any rights under it to any third party. Clevr House may assign this Agreement in connection with a merger, acquisition, reorganization, or sale of assets.

21. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of Romania, without regard to conflict-of-law principles. Mandatory consumer protection rights available to you under the law of your country of residence are unaffected.

For consumer disputes, before initiating legal proceedings we encourage you to contact us at office@clevr.house so we can attempt to resolve the matter amicably.

EU Online Dispute Resolution: If you are a consumer in the EU, you have the right to use the European Commission’s Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is office@clevr.house.

Subject to your mandatory consumer rights, any disputes will be subject to the exclusive jurisdiction of the courts located in Bucharest, Romania.

22. Entire Agreement

This Agreement, together with our Privacy Policy, Compliance page, and any product-specific terms referenced at purchase, constitutes the entire agreement between you and Clevr House regarding the use of our products. It supersedes any prior oral or written agreements or communications.


Plain English Summary (Non-Binding)

  • ✅ You can build unlimited personal devices from our files for your own use.
  • ✅ You can share photos, videos, and descriptions of your builds with credit.
  • ❌ You cannot sell devices made from our designs, or run a business around them, without a separate commercial license.
  • ❌ You cannot redistribute our files — not even for free, not even unmodified, not even privately to a friend. Every user must buy their own copy.
  • ❌ You cannot publish modified versions of our files.
  • ⚠️ Physical PCBs come with the EU 2-year legal guarantee for consumers. If yours is defective, send us proof (photos or a short video) — we’ll ship a replacement and you don’t need to send the broken one back. We may ask for a photo showing the defective unit marked out of service.
  • ⚠️ You are responsible for safe assembly and compliance with local electrical and building codes.
  • ⚠️ We are not liable for misuse, improper installation, or damage you cause — but we never exclude liability for death, personal injury, or gross negligence.
