Clevr House Digital Goods & Physical Products License Agreement

Welcome to Clevr House! We’re excited to support your home-automation projects with our digital design files, PCBs, and guides. This License Agreement explains what you can—and cannot—do with our products. Please read it carefully before purchase or use.

1. Scope of License

When you purchase a digital product from Clevr House—including but not limited to PCB layouts, schematics, Gerber files, firmware, software, or 3D models—you receive a personal, non-exclusive, non-transferable license to use the files in accordance with this Agreement and the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International License (“CC BY-NC-ND 4.0”).

2. Relationship with Creative Commons

All Clevr House digital products are also licensed under CC BY-NC-ND 4.0.

If there is any conflict between the Creative Commons license and this Agreement, this Agreement will prevail with respect to:

• Liability and warranty disclaimers
• Governing law and jurisdiction
• No-redistribution of purchased files

3. Permitted Uses (Digital Goods)

You may:

• Build: Download our files and create physical devices for your own personal, non-commercial use.
• Share your work: Display photos, videos, or descriptions of devices you built using our designs, provided you credit Clevr House (a link to https://clevr.house is appreciated).
• Modify privately: Adapt files for your personal use, but you may not distribute modified versions.

4. Restrictions (Digital Goods)

You may not:

• Use the files or physical devices derived from them for any commercial purpose (including resale, installation services, or business promotions).
• Redistribute, resell, sublicense, or otherwise share the original digital files, whether free or for a fee.
• Distribute modified versions of our design files.
• Remove, obscure, or alter any copyright, trademark, or attribution notices embedded in the files.

5. Intellectual Property

All intellectual property rights in the digital files and physical product designs remain the exclusive property of Clevr House. Purchasing or downloading our products does not transfer ownership of any rights.

6. Right of Withdrawal (EU Consumers)

As a consumer in the European Union, you have the following rights:

• Physical Products: You have the right to withdraw from your purchase of physical goods within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire physical possession of the goods.
• Digital Products (Schematics, Files): The 14-day right of withdrawal does not apply to digital content if the performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. By placing an order for digital goods on our website, you are giving this express consent.

7. Digital Products – No Warranty

All digital products are provided “as-is” and “as-available” without warranties of any kind, express or implied. Clevr House does not guarantee that the files are error-free, compatible with all systems, or compliant with any safety or regulatory standards.

8. Physical Products (PCBs and Hardware)

When you purchase a physical PCB or hardware product from Clevr House:

• Ownership: You own the physical product. Intellectual property rights in the design remain with Clevr House.
• Legal Guarantee (EU Consumers): If you are a consumer in the European Union, your purchase is covered by the mandatory 2-year legal guarantee under Directive (EU) 2019/771. This guarantee applies to defects in materials or workmanship that existed at the time of delivery.
• Exclusions: This guarantee does not cover:
  • Damage caused by improper assembly, soldering, installation, or handling
  • Use of incompatible or faulty third-party components
  • Modifications, alterations, or misuse of the PCB or hardware
  • Normal wear and tear
• Business Purchases (B2B): If you purchase as a business (not as a consumer), physical products are sold “as-is” without any warranties, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, Clevr House, its owners, and affiliates are not liable for:

• Any direct, indirect, incidental, or consequential damages, including but not limited to property damage, data loss, personal injury, or financial loss.
• Any issues arising from use of third-party components, tools, or services in conjunction with our products.
• Any claims related to installation, operation, or misuse of devices built from our designs.

By purchasing and using our products, you assume full responsibility for your projects and agree that you are solely responsible for compliance with local safety and regulatory requirements.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of Romania / European Union law. Any disputes will be subject to the exclusive jurisdiction of the courts located in Romania.

11. Commercial Licenses

If you wish to use our designs for commercial purposes, you must obtain a separate written license. Please contact us at license@clevr.house.

12. Entire Agreement

This Agreement, together with CC BY-NC-ND 4.0, constitutes the entire understanding between you and Clevr House regarding the use of our products. It supersedes any prior agreements, oral or written.

• ⚠️ Physical PCBs come with the EU 2-year legal guarantee for defects (consumers only), but not for misuse or improper assembly.
